BRAI History
The seed for an association to represent and regulate real estate agents in Bangalore was sown on 8th December 1998 by Mr Irshad Ahmed of Irshad’s Property Matters , when he convened a meeting of a few agents and formed a committee for the purpose

The mission was to create a platform on which real estate agents could  meet to address their various audiences viz customers, developers, government and the media. Further the need was to regulate conduct  with responsible, honest and transparent service to customers, to inculcate modern , professional modes of conducting business.
   
   
 It was 4th February 2000 by the time a the association was formally registered with a Memorandum of Articles and a set of  Rules and Regulations. The formal inauguration took place on 29th July 2000 at the Hotel Oberoi.

The members of the founding Governing  Body were Mr. M Hussain of Auto Associates as President Emeritus, Mr Farook Mahmud then President BRA-I was elected the first President of NAR-I and Mr Irshad Ahmed then Secretary BRA-I, was elected to the board of NAR-I, Mr.

Pradeep Joe of First Estate as Vice President , Mr. Tosher Hormusjee of Artee Hormusjee as Treasurer , Mr. Feroze Abdullah of Feroze’s Estate Agency as EC-Member, Mr Sevenraj of Sevenraj’s Estate Agency as EC Member, Mr. Tarvinder Singh of RK Estates as Director , Mr. Siddique Beary of Beary’s Real Estates as Director.

Gradually BRA-I began to enter the public consciousness with directory releases, education courses, and media reportage. Initially housed within the office of Irshad’s Property Matters who gave the space gratis, BRA-I finally purchased and inaugurated it’s own office in the year 2007 in Copper Arch, Infantry road, Bangalore .It was one of the first real estate agent’s associations in India to do so.
   

In 2008 , BRA-I was instrumental in forming NAR-I , the National Association of Realtors-India under the aegis of NAR USA. Mr Farook Mahmud then President BRA-I was elected the first President of NAR and Mr Irshad Ahmed then Secretary BRA-I, was elected to the board.

Significant contributions by Mr Farook Mahmud and Mr Irshad Ahmed have helped to showcase BRA-I both in India and with NAR-USA.

BRA-I has grown in membership to 140 in 2011.

BRA-I is actively managed by an elected Governing Body consisting of 8 members ,working  within the ambit of the Memorandum of Articles of Association and Rules and Regulations. The governing body meets regularly once in a month at the  association’s own office .

The meetings , usually taking 2 to 3 hours , deals with new member applications and interviews, status evaluation of projects under the care of the governing body members , dispute resolutions , budgets , education programmes , NAR-I related projects and conventions.

At least twice in the year , BRA-I conducts education programmes , using educators sent by NAR-USA , ICREA or local talent.

The Disputes Resolution Cell is a mechanism which is quite unusual in India. While avoiding the use of legal options, it aims for impartial intervention and negotiation to resolve difference between members, between members and developers and members and their clients. Significant settlements have been made using this mechanism.

BRA-I as a member of NAR-I takes an important role in the national conventions of NAR-I which are held in rotation in the different member cities. In July 2011 it will be in Hyderabad.

Increasingly BRA-I is being viewed with respect by  developers. Many require that a broker must be a BRA-I member , in order to sell for them.

In 2008 BRA-I conducted the first Transnational Certification Course , an ICREA supported course with an instructor sent by them. Over 90 estate agents from south India took part and are now enabled to do international real estate deals , safely and professionally.

Everyday business is enabled by the facility to list property availabilities and requirements on a email group shared by all  members. In 2011 we are working towards setting up an MLS for BRA-I with national and international links.

Code of Ethics & Standards of Practice

While the code of ethics establishes obligations that may be higher than those mandated by law, in any instance where the Code of Ethics and the law conflict, the obligations of the law must take precedence.
The term NAR-INDIA PROFESSIONAL MEMBER has come to the connote competency, fairness and high integrity resulting from adherence to a lofty ideal of moral conduct in business relations. No inducement of profit and no instruction from clients ever can justify departure from this ideal.

DUTIES TO CLIENTS AND CUSTOMERS

1. When representing a buyer, seller, landlord, tenant, or other client as an agent, NAR-INDIA PROFESSIONAL MEMBERS pledge themselves to protect and promote the interests of their client. This obligation to the client is primary, but it does not relieve NAR-INDIA PROFESSIONAL MEMBERS of their obligation to treat all parties honestly. When serving a buyer, seller, landlord, tenant or other party in a non-agency capacity, NAR-INDIA PROFESSIONAL MEMBERS must remain obligated to treat all parties honestly.

2. NAR-INDIA PROFESSIONAL MEMBERS shall avoid exaggeration, misrepresentation, or concealment of pertinent facts relating to the property or the transaction. NAR-INDIA PROFESSIONAL MEMBERS shall not, however, be obligated to discover latent defects in the property, to advise on matters outside the scope of their real estate business knowledge or to disclose facts which are confidential under the scope of their agency agreement if any.

3. NAR-INDIA PROFESSIONAL MEMBERS shall cooperate with other brokers / other NAR-INDIA PROFESSIONAL MEMBERS, except when cooperation is not in the clients best interest. The obligation to cooperate does not include the obligation to share commissions, fees, or to otherwise compensate another broker.

4. NAR-INDIA PROFESSIONAL MEMBERS shall not acquire an interest in or buy or present offers from themselves, any member of their immediate families, their firms or any member thereof, or any entities in which they have any ownership interest, any real property without making their true position known to the owner or the owner’s broker. In selling property they own, or in which they have any interest, NAR-INDIA PROFESSIONAL MEMBERS shall reveal their ownership or interest in writing to the purchaser or the purchaser’s representative.

5. NAR-INDIA PROFESSIONAL MEMBERS shall not undertake to provide professional services concerning a property or its value where they have a present or contemplated interest unless such interest is specifically disclosed to all affected parties.

6. NAR-INDIA PROFESSIONAL MEMBERS shall not accept any commission, rebate, or profit on expenditures made for their client, without the client’s knowledge and consent.

7. In a transaction, NAR-INDIA PROFESSIONAL MEMBERS shall not accept compensation from more than one party, even if permitted by law, without disclosure to all parties and the informed consent of the brokers ,client or clients.

8. NAR-INDIA PROFESSIONAL MEMBERS shall keep in a special account in an appropriate financial institution, separated from their own funds, monies coming into possession in trust for other persons, such as escrows, trust funds, clients monies, and other like items.

9. NAR-INDIA PROFESSIONAL MEMBERS for the protection of all parties shall assure whenever possible that agreements shall be in writing, and shall be in clear and understandable language expressing the specific terms, conditions, obligations and commitments of the parties. A copy of each agreement shall be furnished to each party upon their signing or initialing.

10. NAR-INDIA PROFESSIONAL MEMBERS shall not deny equal professional services to any person for reasons of race, color, religion, sex, handicap, familial status, or national origin. NAR-INDIA PROFESSIONAL MEMBERS shall not be parties to any plan or agreement to discriminate against a person or persons on the basis of race, color, religion, sex, handicap, familial status, or national origin.

11. The services which NAR-INDIA PROFESSIONAL MEMBERS provide to their clients and customers shall conform to the standards of practice and competence which are reasonably expected in the specific real estate disciplines in which they engage; specific ally residential real estate brokerage, real property management, commercial and industrial real estate brokerage, real estate Appraisal, real estate counseling, real estate syndication, real estate auction and international real estate.

12. NAR-INDIA PROFESSIONAL MEMBERS shall not undertake to provide specialized professional services concerning a type of property or service that is outside the field of competence unless they engage the assistance of one who is competent on such types of property or service, or unless the facts are fully disclosed to the client. Any persons engaged to provide such assistance shall be so identified to the client and the contribution to the assignment should be set forth.

13. NAR-INDIA PROFESSIONAL MEMBERS shall be careful at all times to present a true picture in their advertising and representation to the public. NAR-INDIA PROFESSIONAL MEMBERS shall also ensure that their professional status (e.g. broker, appraiser, property manager, etc.) or their actual status is clearly identifiable in any such advertising.

14. NAR-INDIA PROFESSIONAL MEMBERS shall not engage in activities that constitute unauthorized practice of law and shall recommend that legal counsel be obtained when the interest of any party to the transaction requires it.

15. If charged with unethical practice or asked to present evidence or to cooperate in any other way, in any professional standards proceeding or investigation, NAR-INDIA PROFESSIONAL MEMBERS shall place all pertinent facts before the proper tribunals / arbitration boards of the Member Association or Affiliated institute, society or council in which membership is held and shall take no action or disrupt or obstruct such processes.

16. NAR-INDIA PROFESSIONAL MEMBERS shall not knowingly or recklessly make false or misleading statements about competitors, their businesses, or their business practices.

17. NAR-INDIA PROFESSIONAL MEMBERS shall not engage in any practice or take any action inconsistent with the agency or other exclusive relationship recognized by law that other NAR-INDIA PROFESSIONAL MEMBERS have with clients.

18. NAR-INDIA PROFESSIONAL MEMBERS shall not engage in any practice or take any action inconsistent with the laws of the land.

19. NAR-INDIA PROFESSIONAL MEMBERS shall give optimum service to their clients and should not charge more than the recommended brokerage fixed by the respective city association.
